Insurance Coverage: From a Law Perspective
In reality, we often look at policy provisions and risk in retrospect. We look at the policy, apply exclusions, and tell the insured that they could have purchased different coverage if the risk that actually occurred was one they wanted to protect against. Most litigation concerns provisions no one really considered until after the fact.
Perhaps the most important thing to understand from a client is what risks they actually need to manage. It is not reasonable to believe anyone can be covered for every single possibility that could arise – there will be outliers. This portion will focus on identifying the risks that can be anticipated and how best to cover those risks.
Lastly, we will have a discussion on how utilizing the right life insurance policy along with a business succession plan will provide great value to clients and can be used to effectuate planned buyouts.
Rick is an attorney with the Godwin Dold law firm in Rochester, Minnesota. Since being
admitted to the Minnesota bar in 2013, Rick has represented both businesses and individuals in a
variety of matters including mergers and acquisitions, divestitures, succession planning,litigation, and regulatory issues.
Rick began his career with the Rochester Area Builders as the Public Affairs Director. He then began practicing law at Wendland Utz in August 2013. In June 2014, he, along with James Godwin, launched Godwin Dold. In August of 2015, Rick and James Godwin joined the Bloomington, Minnesota based law firm, Larkin Hoffman before relaunching Godwin Dold in April 2017.
Rick's clients rely heavily on his experience with complex transactional and dispute-related issues. He works closely with his clients to provide practical and effective solutions to every situation.
Rick is the current board president of Legal Assistance of Olmsted County and has served on many other non-profit and not-for-profit boards in Southeastern Minnesota.
James is a business litigator at the Godwin Dold in Rochester. James has represented individuals,
small businesses, and large companies since 2005 in commercial litigation. From Fortune 500
companies to sole proprietors to no-profits and public entities, James has created solutions for a
wide variety of issues his clients face.
James is a member of the American Bar Association, the Minnesota Bar Association, past
president of the Third District Bar Association, and past president of the Olmsted County Bar
Association. James is an ethics investigator for the Third District Bar Association. James serves
on the board of Family Services Rochester.
James received his B.A. with honors and distinction from the University of Kansas in 2002 and
his J.D. from the UCLA School of Law in 2005. James is licensed to practice in Minnesota,
California, and Pennsylvania.
